Apple sues HTC for "patent violations" - Off-topic

http://www.apple.com/pr/library/2010/03/02patents.html
^yet another reason i'll never buy an iPhone.

I'd love to know which ones they mean. I can guess a few, but would a company like HTC really be THAT dumb??

Not like Apple stole their original user interface for the Mac from Xerox, or anything ...

It's not like Apple isn't in violation of God knows how many Nokia patents....

HAHAHAHAHAHAHAHAHAHAHAAHAHAHAH
You have got to be kidding! Hey, Jobs! I invented cheap plastic and you are using it in your iPhone... I'm gonna sue the pants out of you!
“We can sit by and watch competitors steal our patented inventions, or we can do something about it. We’ve decided to do something about it,”
Does anyone know exactly what they are claiming HTC "stole"?
Besides, in terms of UI, Android UI actually looks a lot more than the iPhone does (even the outer case of the Nexus actually sorta resembles the iPhone to a certain extent), so if you want to sue someone.... sue Google.

Good one there Chainfire!

I just read something on Techcrunch which I believe is right on the money....
Apple thinks it owns the concept of the touchscreen Web phone and it wants other cell phone makers to pay for copying the iPhone or to stop altogether. Who will Apple sue next? Motorola? Palm? Research in Motion?

The handheld touchscreen phone has been around for a while, waaaaaaaaaaay before the "IPhone" concept ever came onto someone's desk over at Apple. I will lose my trust and confidence in the legal system if this "joke" gets any answer from a judge other than "Jobs, stop wasting our time and do something more productive with yours".

Fair enough, the idea was their's first, let's give them that, but how is it hurting them, do apple expect a jury to believe that people choose to buy an iPhone over a Android phone, just because of the Slide 2 Unlock??

You know, because we weren't using styli (pl?) to hit the unlock button on our touchscreen WinMo phones like 7-8 years ago or something. I have my 3gs posted on Craiglist and I swear I can't get it out of my house fast enough. I've always been primarily PC, but over the last few years, my wife went through this Apple "thing". Had to buy her a Macbook Pro, then 2 gens of iPhones. Now I can get rid of this crap and get back to real hardware.
One things I will compliment Apple for though, Their resale value ROCKS. Sold a 2.5GHz C2D MBP on Ebay for 1200 bucks. Non Uni-body. In a bidding war mind you!

Apple - stifling innovation and competition since 1976.
I hope they die in a fire.

Apple/Iphone banning 5000 apps from its stores

Please Apple continue this practice cause it is just making other brands stronger in the market place
Apple is causing a stir in the iPhone community by removing over 5000 apps from the app store due to what they deem as inappropriate content. Apple has long been known for being protective over what gets onto the app store, but never before have they rejected or removed so many apps at once. This recent course of action has caused Apple to receive a great deal of criticism from iPhone users, app developers, and the media.
The official reason of Apple banning the apps is due to what they deem “sexually inappropriate.” While some of these apps are very mature in nature, some are just joke apps that wanted a cheap laugh. In response to the removal of the apps, Apple has posted new guidelines to submitting apps. Here they are as reported by MobileCrunch:
1. No images of women in bikinis ( I personally found this rule highly hypocritical as the SI swimsuit app is a top app on iTunes.)
2. No images of men in bikinis
3. No skin
4. No silhouettes
5. No sexual connotations or innuendo.
6. Nothing that can be sexually arousing
7. No apps will be approved that in any way imply sexual content
I personally, am highly against this stance Apple has taken. Censorship on any level is wrong for a person‘s development, and bad for a society. I may not have agreed with what the banned apps had shown, but they shouldn’t have been banned. We can not live in a society where an entity, whether it be governmental or a business conglomerate, can tell us what we can and can’t watch, listen to, or do, especially when no one is being hurt because of it. Once that line is crossed, we can never go back, and our democratic society we live in will become nothing short of a socialist police state.

As long as it can be jailbroken, I don't mind. They can restrict their device as much as they want until they start messing with the hackers. That just ain't correct!

Also, does this imply the Apple application review committe finds men in bikini arousing? And what about men without bikinis?
Most iPhone users love to lube it up and insert it, so I would assume there are a lot disappointed by this news.

Well, I'm not one for sex or kinky apps, joke wise or not, I don't see the need or point...personal opinion.
However, I do believe that as Apple are putting apps on THEIR store, then they have every right as to what does and doesn't go on their store.
This is a benefit of Windows phones (so far, also depening on WP7!) if we want a program we can go make it and freely distribute it without it needing to be on a store page only.
Apple, annoyingly, have always had that level of control over their customers, it's what happens when you buy one of their products

How can they even try to patent something, that Nikon/cannon and the likes have been doing for going on 30 years?
Isn't this what TTL flash systems are? Or flashguns with built in light metering?!

I know they filed a patent for touch screen and for the keyboard with the pop-up letters.

To be fair, they're not trying to patent the flash, they're trying to patent a scanning flash.
Think of it as a spotlight instead of a flash, which shines over the subject changing its intensity as required.
They're also trying to trademark the use of the word "pod" when it comes to using it in technology. I think Apple have gone a little to crazy... this word has been used in existance on the net/life in general for god knows how long... they have issued a briefing paper to the courts against a start up company who have been developing something they call a "video pod" which is some sort of projector, for the last 10 years!

"Easy" group, who own EasyJet, EasyBus, EasyCar but strangely not the obviously popular EasyWomen often threaten other companies using Easy and even EZ in their names, hoping the massive legal cost needed to defend against them would scare most companies into submission.
At least when Intel tried to trademark the letter P they were told to P off and so came up with Pentium.
The more people hear about Apple's bullyboy tactics the better. Think how much damage similar behaviour did to MS in the 80's and 90's, yet now when they buy a compettitor you hardly hear about it.
Apple are heading for a PR backlash in the future, most likely just after SJ leaves (again) if he has enough sense.

Current flashes that have built in metering still only produce one intensity of light.
So areas can still be under or over exposed.
What apple's idea sounds like it does is meter the entire subject rather than an average and scan the light over the subject adjusting the brightness accordingly, doing all that in the speed of a flash.
heck, ive heard apple wants to take legal action against anyone who jailbreaks their iphone. ipod touch, or ipad, because the high and mighty jobs does not approve. whats even scarier is awhile back i read on pocketnow.com that apple had submitted a patent request that would allow the iphone 4 to take pictures of whoever is holding it, and if it doesnt match up with the owner then it notifies the cops. itll even measure heartbeats and track you on gps. seriously, apple is starting to behave like a corporate version of Big Brother from george orwells "1984" book. apple is going needed an ass beating in the form of a legal case to put it back in its place. seriously apple, quit *****ing about everything just because you dont own and/or didnt invent it.

Samsung vs. Apple

Wow...Apple is really powerful! Apple took out Sammy in Australia. If Sammy wants to sell the Galaxy Tab 2 in AUS, they have to submit it to Apple for approval.
http://www.engadget.com/2011/08/01/samsung-galaxy-tab-10-1-sales-halted-in-australia-by-apple-suit/
-me like Android, in many ways,!! ..<
Original article:
http://www.businessweek.com/news/20...amsung-tablet-sales-in-australia-on-hold.html
Basically they've agreed not to sell or advertise it without giving 3 to Apple 7 days before they release it for sale in Oz.
So they can sell it as long as they comply with that agreement.
They save on advertising, drum up more interest, and are still able to release it on the planned date.
To recap:
Samsung are able to release it as planned but agreed not to advertise it before release date.
Three lucky apple employees get to play with the new tablet 7 days before everyone else.
Apple has some big stones. theyre probably going to look at why android has bigger market share and then copy it.

I know a couple of news papers that could do with your out-of-context, misrepresented, reporting of an Engadget story
Xaccers gives a much more accurate account.
The other thing not mentioned is that if Apple loose the case against Samsung then Apple have to pay damages to Samsung. Its basically a "gentlemens agreement" by the looks of it - and as said, Samsung get free advertising!
samsung all the way
android rocks
Looks like Sammy isn't bothered by Apple's concerns. Sammy intends to sell a different, non-violating, version of the Galaxy Tab in AUS from the restricted US version.
http://www.engadget.com/2011/08/02/samsung-will-release-galaxy-tab-10-1-in-australia-despite-apple/
So engadget not only don't bother to read the sourse article properly, but they also don't bother to read their own articles!
Both earlier artiles mention that Samsung planned to sell the Asia version not the US version in Oz.
And people thought News of the World journalists were unprofessional...
Whoa! Sammy is getting really, really bold. Sounds like they might get themselves in the sights of George Lucas if they continue with that attitude...lol

My 2 cents on Apple (the first "real" computer I programmed on was an Apple II in Assembly and Basic....). So much for my age...
- Great design - both industrial and interface-wise
- fabulous marketing and advertising - they could spin a leaky radioactive battery into a great new feature....got to hand it to them
- It just works
- Piss poor attitude and positioning (my way or the court)
- You want what? "User freedom" Llllloooooolllllll....User freedom means WE KNOW BEST, righty?
- Innovation ? Yeah, we get to define what that means (like callling putting a camera on a phone an "innovation" in 2010....)
Well, once you open up the gates by allowing software patents on stuff like "look and feel", you get what you asked for - and Apple "borrowed" quite a lot of *that* on the early macs from real old Xerox Parc work in the 60/70's....look up "Alan Kay", PARC, "Dan Ingalls", "Douglas Engelbart" and so on. So neither the look or the feel is really theirs.
****. I used the "A***" (hint: fruit from a tree which grows in orchards) word. May I get sued for unauthorized use of THAT?

Apple now owns the "slide to unlock" gesture

Source: http://www.infoworld.com/t/intellec...lock-patent-stomp-android-or-windows-8-177178
You might think that at least two features in Microsoft's Windows 8 Developer Preview may come perilously close to infringing on Apple's "Slide to Unlock" patent.
As currently constituted, the Windows 8 Lock Screen requires a slide -- from bottom to top -- to reveal the logon screen. And the optional Windows 8 picture password feature (the subject of its own Microsoft trademark filing) requires the user to define and repeat a pattern of three touches on the screen.
You might also think that every slide-to-unlock Android device manufacturer would be quaking in lead-lined boots, with Apple's lawyers poised to shoot down their unlock screens.
It doesn't take a team of patent lawyers to see similarities between Windows 8's swipe-up-to-unlock and touch-to-log-on gestures, and Apple's unlock shtick. But do either infringe on Apple's patent? Every Android device starts with a swipe, but was Apple first to the mark? Take a closer look.
The U.S. Patent and Trademark Office granted Patent 7,657,849 (alternate source) to Apple on Feb. 2, 2010. Shortly thereafter, Apple sued HTC for its slide-to-unlock transgressions. USPTO granted a very similar patent to Apple, number 8,046,721, on Oct. 25, 2011.
Here's the abstract for the first Apple patent, issued almost two years ago:
A device with a touch-sensitive display may be unlocked via gestures performed on the touch-sensitive display. The device is unlocked if contact with the display corresponds to a predefined gesture for unlocking the device. The device displays one or more unlock images with respect to which the predefined gesture is to be performed in order to unlock the device. The performance of the predefined gesture with respect to the unlock image may include moving the unlock image to a predefined location and/or moving the unlock image along a predefined path. The device may also display visual cues of the predefined gesture on the touch screen to remind a user of the gesture.
The abstract for the second Apple patent, the one issued yesterday, is identical to the earlier patent, except it includes one more sentence at the end: "In addition, there is a need for sensory feedback to the user regarding progress towards satisfaction of a user input condition that is required for the transition to occur." The older patent is listed as a parent case.
As the 9to5Mac site explains, the Neonode N1m phone had a slide-to-unlock feature that predated the first Apple patent by more than a year. "Interestingly," the site says, "a Dutch court ruled that the slide to unlock patent was invalid because of this very device." Indeed.
Take a look at tnkgrl's ancient video review of the N1m at around 4:15 into the clip. See how the N1m implemented a left-to-right unlock swipe? Of course, Apple would argue that the N1m swipe doesn't include "sensory feedback to the user regarding progress." Perhaps that's why Apple filed the second patent.
American courts aren't held to Dutch precedents, but whatever sanity prevailed in the Netherlands should hold some sway on this side of the Atlantic. It's hard to believe that Apple could sandbag Android on swipe to unlock, thanks to the N1m.
As for the Windows 8 speculation, while patents are subject to interpretation in ways that defy gravity, if not logic, the dozen-or-so dense pages of description in the two Apple patents appear to let Windows 8 off the hook. The pertinent "claim" involves:
...detecting a contact with the touch-sensitive display at a first predefined location corresponding to an unlock image; continuously moving the unlock image on the touch-sensitive display in accordance with movement of the contact while continuous contact with the touch screen is maintained, wherein the unlock image is a graphical, interactive user-interface object with which a user interacts in order to unlock the device; and unlocking the hand-held electronic device if the moving the unlock image on the touch-sensitive display results in movement of the unlock image from the first predefined location to a predefined unlock region on the touch-sensitive display.
While the Abstract doesn't delve into the meaning of an "unlock image," this claim in the patents makes it clear that Apple's patented process only applies to dragging a bunch of predefined pixels across the screen. Neither the Windows 8 lock screen nor the picture password feature require the user to drag an image across the screen.
It looks like Windows 8 dodged the bullet -- this time.

Anyone into the lockscreen development realm needs to be mindful of this, if they don't want to be sued.
The US patent system is FUBAR. I despise the ability to patent such a generic ability. Especially when it existed in other areas first.
Love apple hardware (best trackpad in the business, bar none) but I really dislike the legal/patent shenanigans.
ahh... no problem
slide 2 unlock is sooooo old school
we got Face Unlock from ICS
and 1 touch unlock from CM
and WiFi unlock from 3rd party apps
and... soooooo much more options in market

Not just the generic ability, but it's open source they're trying to patent parts of. Android functions under GPL for the most part. GOD I hate Apple with such an indescribable passion!!!

they are ridiculous. pissed that a superior class of devices designed for a wider variety of users with a wider variety of income is outselling their overpriced and "on lockdown" garbage.
but hey, whatever let's make the consumers pay for it.

Yeah Apple sucks. Their controls and locks are pretty stupid too. It limits functionality like crazy. Then they come in and try and force everyone to use their inferior product. I seriously hope they get sued for antitrust.
And the worst of it is, this is not even Apple's "invention": http://www.youtube.com/watch?v=Tj-KS2kfIr0 (seek to 4:00)

This doesn't have to be a problem for Google. All they have to do is, first of all after making Android legal, simply license the slide-to-unlock property of Apple.

The point is, they shouldn't have to worry about that crap.
I believe the patent in question actually specifies a full slide where you actually have to slide your finger clear from one side of the locking mechanism to the other. If a flick gesture achieves the same end it is not in violation of said patent. I've never slid my thumb even halfway up the screen.

Not very flexible though, not even java. And who knows how much the browser is capable of. But who cares, it's a really, really neat little thingy!

Well, it's really easy to avoid infringing this Apple technology, simply go back to what was being used before the iPhone's slide-unlock feature appeared: Tapping an unlock button.

Perhaps you should watch the N1m video. Your timeline appears to be skewed.
On winmo there was an application that looked almost like the top of a rotary dialer that you slid to unlock long before iOS had it. They were just the first ones smart enough to patent it, and good for them.

The slide to unlock patent has already been ruled invalid in Europe.

Patenting things invented by others is ridiculous and should not be possible. A patent should only be able to go to the actual inventor. If the inventor foregoes that option it should automatically be public domain. Biotech companies pull the same BS they patent genetic strains cultivated for hundreds of years by farmers and then tell them they have to pay to use it.

We should let everyone know what shame Apple is doing

This thing that Apple is suing every freaking mobile companies/manufactures with their (stolen) patents is really a shame. Look at this very last new of ITC banning the importation and selling of certain HTC phone in US. Whoever buys any new Apple products enable the company to become stronger and stronger, unfortunately not in a good way. Apple is trying so hard and at any cost to get rid of the mobile concurrence. This means hijacking the mobile marketing, which will eventually realize the company's dream to capitalize and control the entire mobile markering worldwide. If we are all a little bit clever, we should really open a campaign and let everyone know what the company plans really are, what they are doing, and work something together to stop this shame.
Please share this, have ur say and let everyone know what is going on, what they are really buying today and what consequence their purchase might cause.
Thanks
Thing is, we who do NOT endorse them through product purchase, already know better. Those who do, won't care about this just like they don't care to blow heaps of money out their a**es. So....

Yea thats true.. Although I am sure there's still someone who doesn't know it and would like to stay away from powering up a company that plans to capitalize and get in control of everything.
A clear message needs to be sent...
i really don't know what apple is trying to do, sueing all the world.. maybe next will be eve cause she bit an apple???
by the way, reading everything is good to know HTC, and maybe Google already have a solution for this patent infrigments, so the android user experience will always be better than iphonish one...
I see no reason for either panic or concern. First of all, look at the range of devices affected: v1.6 - v2.2 You can't even purchase new HTC device with Froyo or older OS. Second, HTC already responded that they do have a workaround in the pipeline that would diminish all claims Apple's suit made.
Take a step back and try to look at the bigger picture. Ask yourself, why is Apple suing Samsung, HTC, etc? My theory is very simple; Apple's runaway success ran out of steam and they losing ground to Android quicker then Apple engineers are able to put together a new product. Earlier today Andy Rubin bragged about 700,000 daily activations. Simply put, Apple is scared of competition. Nay, they are scared ****less. Since they can't compete by innovating they choose to fight by litigating.
If there is one thing I have agreed with Jobs on, was his musing that "market will sort everything out". It looks like market already did just that and the new is not good for Apple, hence the lawsuits.

Obviously you don't know what ur talking about (take it as a polite way to call you troll).
What Apple has been doing ever since it joined the IT market back in 1985 is to steal other ideas and projects in a legal manner, then patent them and use them against any company/manufactures.
Btw Apple calls this "REINVENTING". Just like they reinvented the phone, reinvented the way to interact between apps, DLNA, the cloud, the pull down notification bar, and the list goes on on and on..
I think I said pretty much all..
Apple business model will fail not now but in the future. What apple is trying to do is to stall it in a way. They already knew sole proprietary will fail, they almost went under at the start..
Steve jobs started a vendetta againts the android os. This is common knowledge. He got mad that someone in his company said NO left and made a product just as good.
My thing is how and why would apple try to sue something that isnt even their os. Thats like microsoft suing apple for a double click to open a file. Or adobe suing java, its childish.
Or ford suing all car manufacturers for having a break pedal.
Noting was stolen, apple has its own OS and android has theirs.
In my opinion suing for how a devices behaves. Its stupid dumb and im surprised the judges havent said that.

And you are wrong. (call it a polite way of calling you a liar). Apple never steals. They never stole from IBM or Xerox. If a tech is owned by another company, Apple will license it if the need it...or buy it.
This just in: Apple owns another patent. They don't steal, they own.

You, obviously, came here to work up hate and anger for Apple. And I do see and read. I see Apple as the victim here. The others are violating Apple and you are "shilling" for the guilty.
Patents are the most rediculus things I have ever seen...
Patents should be used for something totally unique in innovation like design and stuff and not for something that is like a building block of every other phone too...
And buying someone else's patents is bull****...it shows that the company is not innovative and steal others ideas and just keeps on bragging that they have done all the innovations....
Talking about stealing...apple has also stolen other's stuff like the drop down notification bar, siri etc etc...but google and other companies never patent everything they innovate because they know that somethings are crusial for every phone and its very anti innovative to patent those things...
I wonder what will happen when the Patent Office starts accepting patents for things other than technology...then the whole world will start suing each other...and another world war will begin...
And look what Steve Jobs said in his biography that he can even go for a bio nuclear war to stop android....which shows how greedy he is that he can destroy the whole world just for something **** like iPhone...
And people want to move towards open source bacause its very innovative and free too...

Typical. People who hate Apple focus on one tiny little thing they do and ignore the mountain of violations the other companies have been doing against Apple for years.
And Apple owns Siri. They bought the technology from the creator of an Apple app and improved it and made it more perfect. That's what Apple does.

This is the typical Apple fan mode of operation:
Apple Fan: "Apple invented all this stuff!!"
Someone: "Err, no they didn't. There was this, that and the other stuff, which Apple copied."
Apple Fan: "Yeah, well, Apple owns the patents!!"
Suddenly it's not important anymore that Apple hasn't invented anything. And they're completely oblivious how what this does is point to the brokenness of the patent system, as opposed to pointing to the supposed brilliance of Apple.
