I think I could provide a non root solution. But it would create 2 types of settings app on your phone. Not 100% sure on this though...

Isn't there an option in settings>display and buttons and gestures to set a capacitive button as menu? I'm running a port of the One on my HTC Evo LTE, but don't know if official gas it or if our devs just threw it in. I know it existed in the sense 4 software.

Root your phone, unlock bootloader and install custom recovery, then install XPOSED framework and install the menu button mod. Otherwise install a custom Rom with the setting enabled.
Or if you don't want to do any hacking, wait for HTC to possibly fix this.

Hey guys thisbis my first post. Im running cm 10.2 and having issue with 4.3 roms. On forum apps like xda and tapatalk there is no 3 dot menu. Please help as i hate logo to menu. Thanks

I'm not running10.2 right now, but have you gone to the setting and tried to change it? I believe the setting for this would be under advanced, but I can't be sure. Actually, I don't know if CM even has a black bar feature!
Looks like you may be stuck with the notexactlyonbuteversoslightlyabovethelogotoaccessmenu feature.
When I was running CM, I thought the menu key was very convenient and just takes a little getting used to.

go to settings, system, then hardware keys, then under home key (long press), change it to menu

Is there a way to have no screen lock? Like if the phone is locked and I press the on/off button in instantly unlocks without needing to slide up the lock screen.

Yes Go to setting>personalize>lock screen style>no lock screen>apply.

i have noticed on the lock screen the dock is transparent, but on the main screen it is not, im not rooted so is there any way to get the dock like this on the main phone screen

Without root you can't...
ThanKs ,HTC do do some stupid things in stock roms this being a good example ,transparent dock on lock screen but not on phone screen

However, root is very simple to acheive, if in a future you will have this trasparent
Can't root as I use some apps that will not work on rooted devices,my main tv streaming app is one of them
