I have been in contact with several friends of mine in the legal field who have direct friends in the class action field. They will be able to draft a complaint for us against HTC for their deceptive business practices. What we need is a list of those of us who have so far paid the actual 35 dollar restocking fee to AT&T because of this bootloader issue. I.e., we paid for the phone with the understanding that the bootloader would be unlocked per the statements of HTC's CEO. We purchased a phone with expectation of certain abilities and we are actively denied them. We are thus forced to return our phones and are charged a fee from AT&T/HTC.
I am assured that we will be able to mount a good attack on them because of these lies. Anyone willing to put their name down as representatives of the class? Im returning mine tomorrow and will be the first to sign my name on the dotted line with the receipt to prove that their deceptive business practices/outright lies by the CEO of the company have cost me 35 dollars.
Edit : And more.....
Andrew Ogden Feel free to message me if you would like to be included (I have received 33 messages in the last 13 minutes since this post). We are also drafting an FTC complaint against HTC. 1 hour ago · Like
HTC Hi Andrew - We're working on this, but unfortunately I don't have anything yet. Check out this thread for more: https://www.facebook.com/HTC/posts/10150571266758084 16 minutes ago · Like
Andrew Ogden Oh I am aware of that conversation. So are the 86 people so far who have messaged me on Facebook about their returns of the vivid already. I have 11 images of receipts showing the restocking fees that this debacle has been costing us. Once we hit 50 then complaint will be filed. Since it took 1 hour to get 11 confirmed customers damaged by the lies of HTC, I imagine well file by close of business tomorrow.
How about those of us who are unable to return the device? I hate to say it, but I'm looking on CL for Skyrocket trades.

We are still working on a way to include that in the statement. If you incur any costs going to another phone, as in paying EVEN more to get rid of your less than advertised phone, then we might be able to get it in.
First post updated. 11 confirmed receipts of those paying restocking fees over this issue so far. Once I get 50 the filing will go out. Keep the receipts coming.
36 receipts so far
Sent from my vivid which is going back to AT&T because of HTC's Lies about the bootloader

This is clearly a case where legal action is warranted. To do it well you need a lawyer, I dont see an issue there. Lawyers provide a needed service.
I'm returning mine on Sunday and will be more than happy to provide a copy of my receipt for you. That is if att allows me to return it. When I bought it they said I had returned too many phones this year. It's not my fault they sell crap

I'll be returning this phone and buying hence a more expensive model due to HTC lack of promise. I'll show you copy of my receipt when I return it and gladly sign on dotted line.

I have heard a couple of mixed things about this...so maybe someone can clarify for me...
Is it they Are not going to and Refuse to unlock the bootloader
OR
Are they saying it just isn't available now at this moment and will get around to it?
...Cause I have heard both....but don't really understand enough to know what the truth or what is actually happening...
Thanks

a bit of both.
1. The CEO Stated on May 26th that HTC would "no longer be locking the bootloaders on our devices"
LIE Unlike Samsung, HTC Bootloaders are locked by default and users must jump through hoops, including signing away their right to warranty to unlock them... when an unlock is even available for their device
2. Many Devices, the HTC Vivid amongst them, have no unlock available
3. HTC's closest statement to an actual statement on the issue, is that they have no unlock available. They "continue to work with carriers to unlock devices"
4. AT&T sells Samsung phones unlocked by default, meaning this is not a carrier issue.

Thanks for the reply, yeah that would have been my next question, cause I know with some other carriers like sprint, It's the carriers decision.
I wonder...

I've finally gave up on HTC, and saw the 5.3" light that is the Note. I love all the work that is going into this device. Now I want to buy one, but I don't know where? I see many buy from Amazon, but I don't wanna get scammed. I've been fugded over more than once by bad "deals". I don't want the AT&T version because this version is much better. So can you help me find a safe place to buy a note.
Now here's another question. Most (if not all) of the N7000Ns are unlocked. But are those factory unlocked? If I flash a new ROM, or kernel will I loose my unlock? I'm wanting to use this with Straight Talk (Awesome Unlimited Carrier). The bands are AT&T, but I'll have T-Mobile for a good 3 months. So I don't wanna have my cake, and not be able to eat it :0 I see most people here are kind, so hopefully I get some much needed help
I Wish it was a Galaxy Note >:T
Cant really help you with where to get the Note - try some local stores maybe ?
As for the unlocks - if you get the unlocked version, you can flash a new rom or kernel and your phone will remain unlocked.
I bought mine from expansys.US and I bought 1 year insurance for $60.00 from ensquared.com
I bought mine from Handtec in UK (I am in Australia) Thoroughly recommend them and touch wood have had no issues with my wonderful Note.
There are a number of reputable ebay stores - you could also try there.
As far as I know all Notes are factory unlocked unless the carrier has nobbled them!
Got mine on eBay with no issues.

I would say purchase from a seller that offers store warranty or the cheapest source and get third party warranty.
However, I bought mine without warranty from Newegg.com. But again, I am not planning to flash it with custom rom so unlikely it will break within a year. At least two of Galaxy Note I bought from them don't have any white banding or black clipping problem. Probably going switch to iphone 5 in October
Amazon is very reliable. Never had issues with it.
However most of the places that you buy from US wont give u manufacturer warranty for international note.
If u want warranty confirm with the warranty company before purchasing.
I got mine from handtech more than 6 months ago. At that time none offered warrranty to the phone and hence i could not get one.
So far no issues.
you will be able to use with strait talk.
With N7000 u wont get 3g with tmobile.
With att note u can get it but looks very murky now and u will have issues.
You should be fine buying from either eBay or Amazon, as long as you choose a Top-Rated seller (eBay), or a seller with a large # of transactions with 95%+ positive feedback (Amazon).
For the record, I bought mine from a Top-Rated seller on eBay and have had no problems whatsoever.
According to a rep on expansys-usa.com, they'll handle warranty claims for you if you need it. I'm planning to buy from them as soon as my tax refund comes in.

Okay guys,
I have a 2014 Moto X that I bought brand new at best buy about 7 months ago for cash when my phone broke and I wasn't eligible for an upgrade or had insurance. Now it's suddenly not booting past the little globe animation. I've tried various ROMs, kernels, flashing it back to stock, you name it and no matter what it just won't boot past the damn globe.
So I go to the Motorola site to start the warranty replacement process.... They can't find my device on file whenever I enter the IMEI/MEID and request a copy of my receipt... Which I cannot find. I tried contacting Best Buy thinking they could pull the receipt by the IMEI but according to customer service that isn't something they can do since I paid cash.
Do any of you guys know who I can contact about getting a warranty replacement? My carrier (sprint) doesn't want to help me since I bought the phone with cash outside of my contract and claim they can't verify the warranty term because of that, best buy won't give me a receipt since I paid cash, and Moto won't help me without a receipt. I'm at the end of my rope here and would really like to get this phone replaced under warranty and not have to pay more for the replacement than I did for the original phone (the supervisor in the cell phone Dept discounted it to $49.99 just to get rid of it)

Without your receipt, there is nothing you can do. When you pay in cash it's important not to loose the receipt because there is no record of when you purchased it other than the receipt they give you during the purchase. Sorry but you will have to pay for the repair yourself since you don't have a receipt.

Yeah, that's what I figured was going to happen. I know I didn't throw the damn thing away, I just have to figure out where I left it. It's frustrating that best buy can't look it up by the IMEI though... Or rather, I KNOW that they can and they just won't. When I worked for at&t, we had incidents involving warranty claims where someone would scream and yell about their phone only being six months old but they bought it at best buy with cash, and we were able to call them and have them look it up by the IMEI (most of the time it was a few months out of warranty and the customer knew it) but when I said that on the phone, BB customer service said they've "changed their retail system since then", which I know is a load of BS, they just want me to come buy another phone.

I used to work for best buy about 6 years ago. They can't look it up by IMEI. The EMEI is not connected to the receipt. It's not that they don't want to, they really can't.

I know this is a bit of thread necromancy (not too bad since it's only a few months old) but I've resolved the issue just in time.
I thought I had lost or thrown away the receipt, but it turns out I had apparently used it as a bookmark for a book I was reading in a doctor's office the same day I purchased the phone and I just decided to finish the book yesterday, took it off my bookshelf and TADA! THERE'S THE RECEIPT!!
I've taken a picture of it and was able to finally proceed with the warranty process and just received an email from moto telling me that my claim has been changed from "on hold" to "open" after being reviewed.
The purpose of this reply is twofold; 1) so I can definitively say that you cannot get a warranty claim through moto directly for no-contract devices without a receipt if they were purchased through another seller rather than straight from moto because they do NOT keep any sort of records that tell them whether or not it's still within the warranty term beyond the manufacture date, so if the phone was physically assembled more than a year ago, the warranty claim system will automatically tell you to provide proof of purchase, and 2) so I can mark this thread solved in case anyone else loses their proof of purchase and searches to see if there's anything you can do (there isn't) if you paid in cash
Whew. My warranty ends 7/17/2016 so I found it just in time!

Late reply, but THIS is absolutely correct. Though they used to be able to about 7-8 years ago, they have indeed changed their inventory system to having some sort of internal identifier. I've found the receipt, and it has a bunch of numbers for the device, but none of them are the IMEI,HEX,MEID, or even the retail SKU from the original box. There's literally nothing, when looking at the receipt, that would allow them to look up that particular sale just by providing the box.
Hello.
Im not really experienced in the topic of smartphones. Pls excuse me for that
I recently purchased a phone on ebay as, according to description, unlocked. It has an AT&T branded OS and when i start the phone i get asked for the network unlock code. I went to AT&T hp and received the code via e-mail. But it seems like, it isnt working.
Which kind of lock is that and how can i bypass it?
I contacted samsung and they will only help me out if i can give them a bill of the purchase. But i didnt got anything.
https://s15.directupload.net/images/181213/msnmd83r.jpg (Image BB-Code didnt work for some reason, mh)
I hope, you guys can help me. Phone wasnt that cheap and in my view its scam, but i dont want to spend money on court. Its not really worth, but still is a big loss in terms of cash.
Thank you very much

You should contact seller and ask for the pin unlock code. If they cannot provide, file a dispute and get your money back.

I already tried to contact him. Ebay support tried to contact him. Both times. No response. Lawyer contacted him. No response. And court will cost, probably. So, no chance to succeed on this way.
And i payed with bank account, not paypal, cuz this seller (mh, i wonder why...) didnt allow to pay via paypal.
So, i need a technical solution. :-/
