I have now been BANNED from posting or commenting on HTC Italia on facebook.
Last I spoke to HTC on the phone, I was given a regional manager for italy and malta who invited me not to call him again because he is a busy man,
I have email HTC's international relations at [email protected] at the behest of HTC United States online support, who suggested I email them and that I seek legal action against HTC in italy via a consumer protection agency.
I am trying to pressure HTC to intervene in this issue by posting on their official facebook page (not htc italia, just HTC)
Does anyone have any advice for me ? What should I do ? Should I actually file a claim against HTC Italy ? Or should I wait and see if they cave in from the pressure ?

Please next time use the Q&A thread if you want to ask any questions or if you need any advice. -->thread moved I have read your other thread and I understand your frustration but this forum is not the right place to post complaints against HTC, like said in the forum rule quoted above, "tell those guys (HTC), not us". If you are 100% sure of everything you are saying and HTC don't want to help you then go ahead and take the necessary actions (for example, filing a complaint to your local consumer protection agency). Unfortunately, we can't help you with this kind of "legal/warranty/find-the-guilty" issue here. You may want to continue to argue with them, I'm almost sure that if you take "legal actions" to get your phone back and repaired, this will take a very long time.

don't you have a way to stop payment on the phone ?
did you pay in cash ? if you used a credit card just refuse the payment and let HTC take it up with them.

When it comes to warranty returns it is your responsability to make sure it get to them the same way you have it and without any proof that it was done by the courier, there is nothing you can do.

Yeah except htc told me to send it by courier, they contacted the courier ; I've spoken to consumer protection and it seems im in the right

Odd. That maybe the way they do it there.
I am really sorry you are going threw this. HTC is normally very good about things like this.
Yeah I honestly just blame the people managing the technical service here, they're just incredibly rude! I'm going to call HTC in Taiwan in an hour and see if I can get this sorted out !
Update: HTC Italy have now admitted to having the responsibility for damaging my device, they told me my device will be fixed under warranty as returned to me 'as new', I'm gonna call HTC Taiwan just to double check that they don't have to send me a new device.
Given the experience I just had, if you ever find yourself in a similar situation my advice is BOMBARD them with complaints and post on their public facebook pages until they take you very seriously

I have been reading alot about the comments every one seems to making regarding the MDA Vario (unlocking or rom upgrading)
I have the latest unlocking including (CID) and i also have the latest upgrades too.
These are the full updated versions which will also change the country settings from other countrys to the full english version.

I think you have a problem, i will post what i want i have forgoten more then you will ever know about mobile communications i have spent the last 27yrs in the communication world, i have worked for motorola, phillips , nokia, in hitech deparments.
You are more then welcome to visit my company here in the united kingdom so you can take it any way you want to, but think what you say before you engadge your mouth with your brain.
We also devolope software and hardware for the mobile world, and some ones software dont work we then fixit or recomend it not to be used at no cost you see we also do things for free.

If your comment wasent aimed at me then sorry for the reply, but if it is then it is no concern of yours if you want the software with a backup service then please ask.
There are people on this forum who are have bad problems with this type of equipment and paying a small charge for what is offered is really to cheap but we at JKS Communications are not to greedy as we have tested and tested again to make sure that every thing we sell is 100% because i can assure that alot of the upgrades and unlocking software isnt safe to use.
If you know anthing about mobile communications you would know this, i have 5 tech guys who work for me full time as we cover most makes on the market and currently have around 400+gig of firmware/software going back to the early tac units all the way to the present day also we have the latest equipment around which run into thousends of pounds, 27yrs i have been in the mobile communications world so i know what i am talking about.
Like i said at the start if your comment wasent directed to me then i apologise for the comments i have made.
And if it was then you are not interested in what i can offer then keep your comments to yourself please.

Hi,
Maybe so that most thing can be found on the internet but do they do what is claimed most dont.
And as fishing for business as you put it how can offering a service to help out those to who have tried out various software and are still having problems with phone's pda's ect which have a street price of around £375.
It seems to me that some find my offer affends if that is the case i will withdraw what i am offering and put the offer on my own website we just thought it would help out as most of the links are dead one's, and some of the programes offered for free are hacked and they do damage to your phone when used we know this as we have a lot of software that we have download for free and it is a waste of time.
As for the software being free on the net which is on the cd well the unlocking programe is and works 100% every time, but the main files for upgrading cost us money one of the files is a full version in english the latest microsoft windows v5 please tell me where i can download that for free not the simple rom update but the full Os system!.

Well this is the funiest yet, how can you call me a ripper? and it isnt a fancy name eather it was formed in 1987 proberly older then you currently are, you dont live in this country according to your details and i can't see how you can pass comment when you have no idear to what you are talkin about you are a class 1 PRATT just go back to school.

It's very sad to see that some nitwit takes free software from this site and tries to sell it. We see too many fricking a-holes on ebay doing the same thing.

Take a run and jump son, the software is not free if it was then i would offer it for free there is no problem there, So please tell me then know it all where i can get a 100% geuine version of windows ver 5 with the latest update for free!!! with a installation serial number.

The only thing with that is, anybody in this section of the forum already has WM5 preinstalled on their device. And we can just strip out whatever we don't want installed. I'm failing to see the benefit of anybody in the "Wizard" area of the forums buying WM5 from you. By the way, I'd also like to point out that normally, in any business, there's always some kind of customer service and professionalism. You may want to do some research into that. I know that, from most of my experiences, if you have a problem, the company gives you sympathy. If you disagree with a policy, most companies would at the very least apologize about the way things are. You, my friend, act as a douche for your company. The software i hve didnt come from this site nor ebay as i dont have an account.
You are such a plank i can see now this forum has got A holes in it and plenty of them who can always pass comment well you can shove it, i got the software it's 100% perfect and works great but thanks to you bunch of upstarts who like to see other members suffer as the software you find on the net isnt that good thats why it is free.

there is nothing fishy here all my software is 100% i had to pay for it which was more then a fiver, so i thought i would help some one out on here with support to help them get there mda sorted and running 100% so i didnt think it was to much to ask, but as you can see it is wrong of me to offer this software at this price so i wont it do not bother me.

for someone with the vocabulary of a 9 year old, he sure does seem confident in his ability to produce working software. As for wm5 being pad for, it does NOT require a cdkey. OEM's that resell it sometimes (I have heard of one) that has added a cdkey to it to it and it was compared to a hardware id. As for a place you can find a full wm5..... everywhere?
How will we know when it's available at AT&T ? Do they usually have a press release or something ? Should I just call the store periodically ?

Logic needed?
AT&T isn't going to send you a text message, they aren't going to call you, and they aren't going to show up at your home or work. You'll know when the Tilt/8925 is released with AT&T when it's either a) Posted here, b) You call or visit an AT&T store every day until it's released, or c) You visit AT&T's website until you see something posted on this particular subject.

What do you mean, they really wont send me a text message. What if I tell them that I really really want it?
Ok just got off the phone with HTC-americas main dealer and this is what he said after doing some checking. ATT gets it 1st witch we all knew already. Also it showed a Launch date of sept again we knew this.
With a bit more checking he said it showed in his comp that They will be selling it on the 14th with orders going out on the 18th meaning the 11th date could very well be the date ATT goes live with theres.
Again this is right from HTC sales site so info sould be correct.

Writing things like that to people who are experienced with phone launches is not the way to invite their help. You asked for advice and they gave it. Can't we all just get along? We are all excited with the release of such a marvelous creation

Here let me put this a way you can understand then.
You will know when you see it up on there site. If you dont know where to look then just ask rather then being a Jackass about it. on the ATT site click support then forums there is a section called announcements it will be post there.
Also you can visit the HTC americas site to see when its live here. Noone is going to hold your hand and txt call or whatever you when its avil you will eather A. have to wait till someone takes pity on you and post here or B. be a big boy and learn to check there sites for yourself.

Rule #422 dont be an asshole. If you post a question such as this at a time like this it is bound to go off topic at some point. However calling people "stupid" or say they cant read just makes you sound like an idiot yourself. Speaking as a fellow noob, I will say that this site has been the best resource I have found anywhere...period. So my advice is dont be rude simply because it went off topic.
Now in regard to your question on at&t previous launches, they suck. I followed the 8125 for a while but was new and didnt really know what I was missing so I at least wasnt losing my mind. The 8525 on the other hand was a different story, lost my freaking mind. I watched several supposed launch dates come and go and it was finally released in November. My way of dealing with this is just have fun with it, trust that it will be worth it, and save some extra cash back while waiting. I personally dont believe we'll see it as soon as everyone thinks though. I hope Im wrong but you could just call it a gut feeling.

Thanks amigo, I appreciate the info. I guess I was just wondering if they'd make it obvious when it was available (web site update) or if you had to go looking for one (calling around to different stores, etc)

Trust me, you will know when AT&T releases this phone! With so much hype just about the rumor dates, imagine when it finally gets released. You won't even have to check their website or visit a store, you will just about see it everywhere.
I hope that it doesn't cost a but load for the service. think Tmobile will get it any time in the next two years? I like Tmobile because I can tweak my plan and have more freedom it feels like; off topic, yes, but why not chat since nobody knows the answer to the thread other than soon

is there anything different about these apks? Are they wifi compatible?
I tried wifi compatibility and it is still in the works but as of now this is only for looks but I am working on wifi as I post this.

On some of the sprint apps it makes you comfirm that you are a sprint customer, so instead of sending sprint our real phone numbers (caller id=your name) we send them fake ones, like 555-555-5555
this seems like not a smart thing for you to do.

so basically you just violated alot of copyright laws....
Unfortunately, some may think, we cannot allow links to modded paying software. The software in question is provided under licence to Sprint users only. Now, we try not to sensor knowledge here, so we not going to delete all references to the fact that this software can be ported to non Sprint devices and used free of charge in breach of terms and conditions, BUT we cannot permit links to the software that would actively encourage members to break the law.

It's not the fact that it is Sprint software ported over to the G1. It is the fact that he removed all of Sprint's branding. That's like taking the the Google Maps app (or any Google app) and removing Google's name from it. It's simply just a breach of copyright.

Well, that too but the whole subject of the Sprint / Telnav software has been raised and discussed with Mods and Admin so there are issues regarding the use of such software on non Sprint phones.

Wow. Mike you have got to be one of the fairest, most logical forum mods I have ever had the pleasure to read. I am very impressed with the way in which this was handled.
mike i thought your site got closed because u had all the htc breakdown videos and what of that? but i do understand the point so i say lets make a new site that will let you post or upload. that way we can get the goods and xda dont get the blame if i remeber november 27 windows came down on xda for the same ish so please pleas dont let it happen to android just look for a new method for the shares. but i do like the work and want the app i was to late late for the link !!!!! I was shut down for a while and had to remove some things, but in the end reached a sort of unofficial compromise on intellectual property rights.
This is a delicate issue, in my case I don't offer folks something they would normally have to pay for through their network or otherwise. (I offer stuff they should not have, even if they have money to pay for it!!).
I guess our bottom line is that knowledge should be freely available, but handing folk the tools, to install stuff that is very close to being Warez, is off-limits. (Robbing banks with an uzi can be profitable = knowledge, but handing out uzis and suggesting you rob a bank, crosses the line)
.... and yes we know cooking ROMs and such is also a grey area, but even there we say that ROMs should not be cooked that include for free any software for which the user would normally have to pay.
If someone set up a site with Sprint software on it - that's entirely up to them. We would probably even accept a link to it if the poster said "hey here's a breakdown of a Sprint ROM" In fact that would probably be OK to post here - at least until someone asked for a "take-down"
The problem only comes when someone says you can load this stuff on non-Sprint phones and get stuff for free and just to help you do that here are the links. In other words that ceases to be a theoretical point of information and becomes an encouragement to do something naughty. If folks want t be naughty then they have to do so, by reading the knowledge and then looking for the tools from whatever source, here or elsewhere without our help.
These kinds of things have been debated many times here at XDA - there are no absolute rights and wrongs, only things we think are more or less safe for us to do - just like life generally I guess

Well said Mike. When I read it, I had a /foreheadslap moment thinking, "well duh, this should be pretty obvious," but im constantly reminded that there are users on here who simply feel they have a right or deserve to have any given piece of software if it is leaked online.
The bottom line is, do not post software that has not been explicity licensed as open source unless you have obtained permission to redistribute. As a general rule of thumb, if the software cannot be legally obtained unless you pay someone (e.g. it comes preloaded on a phone) or can be obtained free but only if you agree to a license agreement (downloading certain software update packages) then you should not redistribute it on xda or elsewhere.

I don't thinks so. This statment even more gives power to our voices. Look at Google and see a lot of big tech forums like "androidpolice" refer to.

I think it is time to let companies know the power of the pro-user. I am constantly recommending people against buying an HTC. They trust me for all their review. On every forum, we must absolutely not recommend anyone an HTC. All of it can be done without lying.
Example:
n00b question: "hey, should I buy the HTC sensation?"
Reply: "No. The bootloader is locked. You'll only be able to run what HTC wants you to run. You either buy a Samsung, or simply get an iPhone."
Yes, the opinion is slightly biased, and hides some information (like the user might never need root). However, as someone who has the privilege of recommending devices to others - How much I disclose, and how neutral I should be, is not covered by the any covenant. So.. screw you HTC. Everyday, I'll try and persuade, at least, one person to not buy an HTC - till you unlock!

I love sense. The only reason I say no is the boot loader. Free our phones. Now!

Actually, it'll just be undoing the worst thing they've done in a long time.
I wrote a two page letter to HTC today one part with personal data and why the S-ON device is not good for me and the other part from the example letter that is posted to the first post blog.
I send it via e-mail directly to some addresses and also via the HTC support..
and here's the reply..

How typical..
It goes without saying that there are benefits to making it difficult to root your phone. A prime example is that once you root your phone. All of your account passwords are unencrypted.
That said, perhaps if the phones were easier to root people would put resources into making sure they're re-encrypted with a good ROM.
But ultimately every user deserves freedom of choice and if rooting my phone is the best/simplest/easiest way for me to uninstall bloatware/configure it as per I need it, then its clearly the best option. Freedom is the key here. Every single user should have a choice.
